1. Acceptance of Terms

By booking a tour through Tours by the Jays, you agree to be bound by these Terms & Conditions. Please read them carefully before completing your reservation.

Tours by the Jays helps connect guests with local Puerto Rico tour experiences. Tours are facilitated and operated by Eliot’s Adventures, a local tour provider. By booking, you also acknowledge that the tour experience, transportation, guiding, safety procedures, and day-of operations are managed by Eliot’s Adventures.

2. Booking & Payment

All bookings require a valid credit card or accepted payment method. Full payment is due at the time of booking unless otherwise agreed in writing.

Prices are listed in U.S. Dollars and may change without notice until your booking is confirmed.

3. Cancellation & Refund Policy

Guests may cancel their tour up to 72 hours before the scheduled tour time for a full refund.

Cancellations made less than 72 hours before the tour, late arrivals, or no-shows are not eligible for a refund.

We reserve the right to cancel or reschedule any tour due to weather, unsafe conditions, road closures, safety concerns, or circumstances beyond their control. If this happens, guests will be offered the option to reschedule or receive a full refund.

4. Breakfast Included

Some Tours by the Jays experiences include breakfast. Breakfast will be a standard breakfast selection chosen by Tours by the Jays unless guests notify us of dietary restrictions in advance.

Guests are responsible for informing us of any allergies, food sensitivities, dietary needs, or restrictions before the tour date. While we will do our best to accommodate dietary needs, we cannot guarantee that all restrictions or allergies can be fully accommodated.

5. Liability & Assumption of Risk

Participation in outdoor tours and activities may involve inherent risks, including but not limited to hiking, uneven terrain, rivers, swimming areas, kayaking, waterslides, caves, weather changes, transportation, and other natural conditions.

By booking, you acknowledge and accept these risks. Tour operations, transportation, guiding, safety procedures, and day-of activities are handled by Eliot’s Adventures LLC. Tours by the Jays is not responsible for injury, illness, loss, damage, delays, or death arising from participation in a tour, transportation, or related activities, except where required by law.

6. Health & Physical Requirements

Some tours may require walking, hiking, swimming, climbing, or a reasonable level of physical fitness. Guests are responsible for reviewing the tour description and determining whether the experience is appropriate for their health, age, and physical ability.

Guests must disclose any medical conditions, injuries, mobility concerns, pregnancy, allergies, or other limitations that may affect their ability to safely participate.

We reserve the right to deny participation to any guest who may pose a risk to themselves, guides, drivers, or other guests.

7. Age Requirements

Certain tours may have minimum age requirements depending on the activity. Unless otherwise stated, tours are generally suitable for guests ages 6 and up.

Parents or guardians are responsible for supervising minors at all times.

8. Late Arrivals

Tours depart at the scheduled time. If you are late and do not provide prior notice, your booking may be forfeited without refund.

Please contact us as soon as possible if you expect to be delayed.

9. Behavior & Conduct

Guests are expected to behave respectfully toward guides, drivers, staff, local communities, other guests, and the natural environment.

We reserve the right to remove or deny service to any guest who is disruptive, disrespectful, unsafe, intoxicated, aggressive, or unwilling to follow guide instructions. No refund will be issued in these cases.

10. Transportation

Transportation may be included depending on the tour selected. Pickup times and locations must be confirmed before the tour.

While every effort is made to stay on schedule, WE are not responsible for delays caused by traffic, road conditions, weather, accidents, guest delays, or other circumstances outside their control.

11. Photos & Media

Photos or videos may be taken during tours for promotional, social media, or marketing purposes.

Please notify us before your tour if you do not consent to being photographed or recorded.

12. Personal Belongings

Guests are responsible for their own personal belongings. We are not responsible for lost, stolen, or damaged items during the tour, transportation, pickup, drop-off, or activity stops.

13. Weather & Safety

Tours may take place rain or shine when conditions are considered safe. However, tours may be changed, delayed, rescheduled, or canceled due to unsafe weather, high water levels, storms, road closures, or other safety concerns.

Final safety decisions are made by Tours by the Jays and their guides.

14. Third-Party Operators

Tours by the Jays may partner with local guides, drivers, vendors, and tour operators to provide guest experiences. By booking, you understand that some or all portions of the tour may be operated by third-party providers.

Tours by the Jays is not responsible for acts, omissions, delays, injuries, losses, or damages caused by third-party operators, vendors, or service providers, except where required by law.

15. Governing Law

These Terms & Conditions are governed by the laws of the Commonwealth of Puerto Rico and the United States of America.

Any disputes shall be resolved in the appropriate courts of Puerto Rico.
